Liability Waiver and Race Agreement:

I know that participating in an Outer Banks Sporting Events race is a potentially hazardous activity. I should not enter and participate unless I am medically able and properly trained. I agree to abide by any decision of a race official relative to my ability to safely complete the run. I assume all risks associated with participating in Outer Banks Marathon activities including, but not limited to falls, contact with other participants, the effects of the weather, including high heat and/or humidity, traffic and the conditions of the road, all such risks being known and appreciated by me. Having read this waiver and knowing these facts and in consideration of your accepting my application, I, for myself and anyone entitled to act in my behalf, waive and release any and all sponsors including but not limited to, the Towns of Southern Shores, Kitty Hawk, Kill Devil Hills, Nags Head, Manteo, Dare County, the State of North Carolina, the Dare Education Foundation, the Outer Banks Relief Foundation, the Outer Banks Sporting Events Organizing Committee, USA Track & Field, Inc., USATFNorth Carolina, OBSE current timing contractor, race officials, volunteers, all municipal agencies whose property and/or personnel are used and all other sponsoring or co-sponsoring companies or individuals, their representatives and successors related to the Outer Banks Sporting Events races from all claims of liabilities of any kind arising out of my participation in this event, even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver. I grant permission to all of the foregoing to use any photographs, motion pictures, recordings or any other record of this event for any legitimate purpose.

Prize Money Eligibility Athlete Statement 

I, the undersigned, as an elite athlete entrant eligible to earn prize money at the above named race, agree and attest that the following statements are true:

• I have not taken a performance enhancing substance on the WADA banned substance list

• As an athlete competing in the United States, I am in compliance with anti-doping policies set forth by USA Track & Field and USADA

• I am not currently serving a suspension or ban issued by the US Anti-Doping Agency (USADA) or the World Anti-Doping Agency (WADA) for use of a banned substance

• I have never served a ban issued by USADA or WADA for the use of performance enhancing drugs

• I am not represented by a coach or agent who has had 2 or more athletes receiving such suspensions in the previous 4 years

• As an athlete, I understand I have a duty to ensure I am represented by a reputable coach and agent, as such, I am not represented by a coach or agent who has served a ban for use of performance enhancing drugs during their own athletic career.

• If I am found in violation of this policy before, during or after this event, I understand I will not be eligible to compete for prize money or awards, and I may be banned from future participation in this event.
